Can a judge use stolen evidence to make a ruling?

If a neighbor tresspassed on my property and took my dog without a warrent, because she thought it was abandoned, can the stolen dog be used to file animal cruelty charges? Can a judge use the dog that was illegally obtained to make a judgement or is that cause for a mistrial or violation of due process?
